2. Who actually owns your data — and what happens to it

In plain English: When you feed your business data into an AI tool, you need to know exactly where it goes, who can access it, and whether it's used to train models that benefit your competitors.

This isn't paranoia. Several major AI platforms have terms of service that allow them to use customer inputs for model training unless you explicitly opt out — often buried in enterprise-tier agreements. For businesses in healthcare, financial services, or legal industries, this isn't just a competitive risk. It's a compliance risk.

A boutique accounting firm discovered, mid-contract, that the AI assistant they'd licensed for client document summarization was routing data through servers in a jurisdiction that conflicted with their client confidentiality agreements. The word "integration" is doing a lot of heavy lifting in most AI sales conversations. There's a meaningful difference between a native, pre-built connector that takes an hour to configure, and an API integration that requires a developer, custom code, and ongoing maintenance. Vendors often describe both the same way.

The integration with their existing project management system — which the vendor confirmed was "supported" — required a $12K custom development engagement with a third-party contractor. Your rule this week: Ask for a technical integration spec sheet, not a sales one-pager. Specifically ask: "What does it take to connect this to [your specific tool]? Can you show me a customer who made that exact connection? What did it cost them and how long did it take?"

4. What the actual support model looks like after you sign

In plain English: The responsiveness you experienced during the sales process is almost never the responsiveness you'll get during implementation.

This is one of the most consistent complaints from SMB buyers who've been through a difficult AI implementation. The sales rep was responsive, the solutions engineer was helpful, and then the contract was signed and you got handed to a ticketing system and a customer success manager with 200 accounts.

For tools that touch core business operations — customer communications, financial reporting, inventory management — slow support isn't just inconvenient. It's operationally dangerous.

One e-commerce retailer using an AI-powered customer service platform ran into a critical failure during their peak season. Their support ticket sat for 72 hours before receiving a response. The vendor's SLA technically allowed for that. No one had read the SLA carefully before signing.

5. How success is defined — and whether they'll stand behind it

In plain English: If the vendor can't define what success looks like in measurable terms before you start, you have no grounds to hold them accountable if it doesn't work.

Vague success metrics are the most reliable sign of a vendor who doesn't fully believe in their own product. "You'll see significant efficiency gains" isn't a commitment. "You'll reduce time-to-quote by 30% within 60 days" is. The specificity of the success definition tells you a lot about how confident they are in real-world performance.

Some vendors will offer performance-based pricing or pilot programs with defined checkpoints. That's worth paying attention to — it signals they've done this enough times to predict outcomes. Vendors who resist putting specific numbers in the contract are usually protecting themselves, not you.

A professional services firm negotiated a 90-day pilot with defined performance benchmarks before committing to an annual contract. The tool hit two of the three benchmarks. The vendor credited them partial fees and renegotiated the scope. The firm got a better contract because the accountability structure existed from day one.

Your rule this week: Before you sign, write down three specific, measurable outcomes you expect within 90 days and ask the vendor to confirm those are realistic. If they say yes, put them in the contract. If they hedge, treat that as a pricing negotiation lever — or a reason to walk.

Different situations call for different levels of scrutiny and different starting points.

If you're evaluating AI for a customer-facing function — sales, support, marketing — start with the data ownership and support questions first. Failures here are visible to your customers, and reputational damage compounds quickly. Pilot in a low-volume channel before you touch anything mission-critical.

If you're evaluating AI for an internal operations function — scheduling, document processing, reporting — the integration question is your biggest risk. Most operational AI tools require cleaner data and tighter system connections than the pitch implies. Require a paid pilot (yes, pay for it — it filters out vendors who aren't serious) and define your success metrics before you start.

If you're in a regulated industry — healthcare, finance, legal, insurance — treat the data governance question as non-negotiable before you evaluate anything else. Have your legal or compliance team review the data processing agreement before the demo, not after. You're looking for disqualifiers, not enhancements.

If you've tried an AI tool in the past 18 months and it failed, the most useful question isn't "what tool should I try next?" It's "what do we know about why the last one didn't work?" If it was an adoption problem, your next evaluation should include change management support as a vendor requirement. If it was an integration problem, your next evaluation needs a technical scoping call before any commercial conversation.

If you're not sure you're ready — if your data is chaotic, your processes aren't documented, and your team is already at capacity — wait six months and do the internal groundwork first. No AI tool fixes a broken workflow. It accelerates it.

Common Traps to Avoid

Buying the demo, not the deployment. The demo is engineered to impress. It runs on ideal data, with an expert driving, in a controlled environment. The trap is treating demo performance as a proxy for real-world performance. Sidestep it by requiring a proof-of-concept on your actual data before you commit to a full contract.

Letting the sales rep define your success metrics. Vendors will happily tell you what success looks like — and they'll define it in terms their product is likely to hit. "Increased engagement" and "faster processing" are not business outcomes. Revenue, cost, and time saved in specific dollar or hour terms are. Walk into every vendor conversation with your own success criteria already written down.

Ignoring the contract's exit terms. Most buyers focus on what happens when things go right. The more important question is what happens when you need to leave. Long data export timelines, high termination fees, and unclear data deletion policies are common contract traps that only matter when you're already in pain. Read the exit clauses before you sign the entry clause.

Discounting implementation complexity because the price looks reasonable. Software licensing costs are often just the beginning. Professional services, custom integration work, internal staff time, and training costs can easily double or triple the total first-year cost. Ask every vendor for a fully-loaded cost estimate, including typical implementation costs for a business at your scale.
